In some cases, when someone from the entertainment industry cannot receive a business visa, then an LMIA-based work permit is the last resort.
As part of the LMIA process, the employers do the advertising to demonstrate that no Canadian is available to perform the job. And that the hiring of foreign workers for a task is not going to have any negative impact on the Canadian labor market.
However, under certain circumstances, the advertisements and recruitment proofs are not needed. This exemption renders the process of employment. However, the employers still have to pay the government fee of $1,000 to facilitate the applications.
Following are the Advertising exempted cases:
Quebec Facilitated Process
The occupation list of Quebec is released annually. This processed list allows the recruitment of foreign workers in the organizations and work-stations in Quebec. The employers need not give the recruitment proofs for the hiring done by them in this province.
Owner/Operator
The individuals owning 50.1 or more percent of shares in new or existing Canadian businesses, i.e., having controlling interest, qualify for this exemption. Such individuals must have a position in the organization from which they cannot be dismissed.
Specialized Service Technicians
To be eligible for this advertising exemption-
The organization must demonstrate that the job is specialized and is being performed by the skilled individual who has appropriate knowledge and prior experience related to the task to be done in Canada.
