Family Class: Specific Requirements

The Canadian government facilitates reunification of families through its Family Class Sponsorship programs.

The permanent residents or Canadian citizens may bring their family members under various categories of the Family Class Sponsorship program. There are specific immigration requirements that should be met to apply for them.

SPOUSE/ COMMON LAW PARTNER SPONSORSHIP

REQUIREMENTS FOR THE SPONSOR

The sponsor must be a Canadian permanent resident or a Canadian citizen, physically residing in Canada
The sponsor must be at least 18 years of age. However, the minimum age for a sponsored person is 16, under this category.
The sponsor must not be in prison, bankrupt, under a removal order (if a permanent resident) or charged with a serious offense in our outside Canada
The sponsor must not have been sponsored to Canada as a spouse within the last five years
The sponsor and sponsored person must not be related by consanguinity

REQUIREMENTS FOR THE NATURE OF THE RELATIONSHIP

THE RELATIONSHIP OF SPONSOR AND SPONSORED PERSON MUST FALL UNDER ANY OF THE THREE CATEGORIES-

SPOUSE : It signifies the legal marriage of sponsor and sponsored person. The certificate of marriage from the territory where the marriage took place is required to prove the marriage valid. However, same-sex marriage will only be considered valid if it is valid under the law of the country where it took place as well as the Canadian federal law.
COMMON LAW PARTNER : Excluding brief absences for business or family reasons, the sponsor and sponsored person must prove that they have been cohabiting continuously for at least one year to establish a common-law relationship.
CONJUGAL PARTNER : Conjugal partners can be of either opposite-sex or same-sex. A sponsored person is defined as a conjugal partner if :

If they have been denied the common law or spousal relationships under exceptional circumstances, such as same-sex marriage, immigration barriers or legal restrictions limiting divorce
They have a mutually dependent relationship for at least one year with the same level of commitment as a marriage or common-law relationship. The proof of emotional ties, financial support, or ownership of assets is required for this category.

INELIGIBILITY CONDITIONS

The immigration won’t be approved If the sponsor –

Has not paid an immigration loan, a performance bond and/or family support payments ordered by the court
Has failed to provide financial stability to previously sponsored members
is under a removal order, or in prison, or is declared bankrupt
is convicted for a serious offense
has received social assistance for reasons other than a disability
were sponsored as a spouse by some other person within five years
Has sponsored another partner and three years have not passed since the earlier sponsored spouse has become a Canadian permanent resident.
have already submitted an application to sponsor his or her current spouse/partner/child, and the approval is pending

PARENT AND GRANDPARENT FAMILY CLASS SPONSORSHIP

Requirements for the Sponsor

To qualify for Canada’s Parents and Grandparents Program, the sponsor (Canadian) must-
Be a Canadian citizen or permanent resident, or a registered Indian under the Canadian Indian Act and should physically be in Canada
Be of 18 years of age or older

not be under a removal order, or in prison, or is declared bankrupt
not be convicted for a criminal or sexual offense.

Provide the proof to IRCC that his/her income is more than the minimum required income for bringing parents or grandparents through the sponsorship program by submitting notices of assessment issued by the Canadian revenue agency

AN UNDERTAKING SHOULD BE SIGNED BY THE SPONSOR-

an additional undertaking must be signed, if the sponsor resides in Quebec, with the province of Quebec
to provide financial stability, and repay any social assistance benefits paid to(if applicable) the sponsored parent for 20 years from the date the relative becomes a PR

Proof that the sponsored person is a parent or grandparent of the sponsor

PARENT AND GRANDPARENT SUPER VISA SPONSORSHIP

REQUIREMENTS FOR THE SPONSOR

The sponsor must be a Canadian permanent resident or a Canadian citizen, physically residing in Canada
The sponsor must be of 18 years of age.
The sponsor must not be under a removal order, or in prison, or is declared bankrupt
The sponsor must not be convicted for a criminal or sexual offense.
The sponsored person must not be a common-law partner
The sponsored person and sponsor must be the parent/grandparent and biological or adopted child respectively
The sponsor must give a written commitment of financial support.
The sponsor must meet the minimum income threshold
The sponsored person must show proof of purchasing Canadian health insurance for at least one year
The proof Completion of an immigration medical examination of sponsored person is required
The sponsored person must be approved as a visitor to Canada
The sponsored person must be in either of the following dependencies-

less than 22 years of age
older than 22 years of age but is financially dependent due to mental and physical conditions.
